Mensah Thompson of ASEPA writes... The Supreme Court of Ghana through its Lawyers , Sory@Law has written to the media to pull down stories they reported about the Court earlier because the Court believes they are scandalous! First of all, this is outrageous, the Supreme Court cannot behave like a private entity in a defamation tussle. This is the highest Court of the Land and it represents the Judicial arm of Government, an arm that is not above media scrutiny or any form of scrutiny from the people. Secondly, the person who made these so called scandalous statements, has been summoned by the Court and has apologized before the Court and same way the media reported the scandalous remark, it has reported the apologies as well. Isn’t that what the media is supposed to do, report? When people criticize the Executive or Parliament, no one writes to anybody to pull down their stories, if they are in contempt of Parliament they are dealt with in accordance with law and the media reports on same. Asking the media to pull down stories from website and other platforms because someone thinks it is scandalous is an abuse of judicial power and to think that the Supreme Court which derives it’s powers from the people is ever seeking to protect itself from the people is even worse. What the Supreme Court is attempting to do is to put fear in the media and prevent it from publishing “unpleasant ” stories about them in future. So the Supreme Court is saying; if the story about us is good publish it, if it’s negative don’t publish, if you do, you will hear from our lawyers. So the Court wants a monotony of praises and never criticisms. Assuming anytime we criticize the Executive or the President, the Attorney General writes to the media house to pull the story down, will there be any media practice in Ghana? The fundamental freedom of the Press enshrined under the Constitution of Ghana did not make an exception for the Supreme Court, free media is one of the key ingredients in a democracy and the moment any arm of Government begins to feel that they are an exception to this rule, then you are nearing anarchy! Press Release To all Media Houses *Gallant Cadres of NDC* 0505446753 *Nana Akufo Addo Must Act On The Petition Seeking Removal Of EC Chair, Jean Mensah Now With Alacrity* Petition for the removal of the Electoral Commission Chairperson from office is received by President Akufo Addo, But he has not acted upon for 20 days in breach of 1992 Constitution.* #Article 146 *#CONVEYOR BELT* THE CONSTITUTION OF THE REPUBLIC OF GHANA: ARTICLE 146 ARTICLE 146 PETITION FOR THE REMOVAL OF THE ELECTORAL COMMISSION CHAIRPERSON, JEAN ADUKWEI MENSA. 12/1/21 INTRODUCTION The Electoral Commission (EC) of the Republic of Ghana is an independent Constitutional body charged with the primary responsibility of organizing FREE, FAIR and TRANSPARENT ELECTIONS. The current leadership under the Chairmanship of Mrs. Jean Adukwei Mensa, knowingly created Constitutional Crises by their actions and inactions in the lead up to the 2020 Presidential Elections as they ignored caution and advise from by various stakeholders of the adverse outcomes and implications of their actions and acts of omission. It is worthy of note, that Mrs. Jean Mensa earlier last year as given an opportunity through a letter dated 4th June, 2020 (copy attached) copied the President of Ghana, the Chief Justice and the Council of State; in the hope of averting this Article 146 action for her removal from office, but Mrs. Jean Adukwei Mensa refused to respond making this instant Petition inevitable. By this instant PETITION and in accordance with Article 146, the President is obligated to forward for the immediate attention of the Chief Justice for the sole purpose setting up the appropriate Committee to thoroughly investigate the allegations made in the Petition by named persons and organizations, to establish a CASE against the Electoral Commission Chairperson ultimately leading to the removal of Mrs. Jean Adukwei Mensa from office as per the Petition.  The Petition is grounded on stated misbehavior of the Electoral Commission Chairperson not limited to gross incompetence, bias, procurement breaches and poor corporate governance practices. The under listed instances of incompetence of the Jean Mensa-led Electoral Commission, bias and poor corporate governance posture has resulted in the following; 1. ADVERSARIAL POSTURE & BIAS: There has been a breakdown of consensus building with stakeholders by the Jean Mensa-led EC and the consequent marginalization of the Inter-Party Advisory Committee (IPAC). The Jean Mensa-led EC created a parallel advisory body, the Eminent Advisory Committee which is largely defunct and has proven irrelevant to the challenges that arose in the course of the work of the Commission leading up to the crises.   ALLEGED COLLUSION OF EC WITH THE NPP The independence of the Jean Mensa-led EC was often compromised. The Jean Mensa-led EC rather than build consensus in taking a decision on the vexed issue of a new voters registration in the middle of the deadly Coronavirus pandemic; resorted to voting at an IPAC meeting after allegedly packing the IPAC with many defunct political parties which were not in good standing per the records of the Electoral Commission, in a bizarre manner allegedly calculated to procure a particular outcome favourable to the New Patriotic Party (NPP). It is instructive to note that, the appointment of the Jean Mensa-led EC after the acrimonious REMOVAL OF THE CHARLOTTE OSEI-LED EC set the baseline for judging the new EC.  The bias and utterances of the new Jean Mensa-led EC has been very evident. Mrs. Jean Adukwei Mensa, the Chairperson, prior to her appointment by President Akufo Addo, had a history with the opposition National Democratic Congress (NDC) which had led to the NDC boycotting her private organization, the Institute of Economic Affairs (IEA) which was involved in National ELECTION Policy Formulation.  A Deputy Electoral Commissioner, Dr. Bossman Asare, who until his appointment by President Akufo Addo, was the Patron of the NPP Students wing (TESCON) of the University of Ghana, had publicly said that the NDC was a threat to Ghana's democracy. The Director of Electoral Services of the EC, Dr. Serebour Quaicoe also by his posture, utterances and very conduct seemed opposed to the NDC and favourably aligned to the NPP.  Many official statements and key programmes of the Jean Mensa-led EC were often publicly announced by the governing NPP before the EC officially came to confirm same verbatim.  2. GROSS INCOMPETENCE: The incompetence of the Jean Mensa-led EC became very apparent before, during and after the Ayawaso West Wuogon BYE-ELECTION. The botched ELECTION SECURITY resulted in an extremely LOW TURNOUT (19%) and other negative manifestations that marred Mrs. Jean Adukwei Mensa's maiden competitive ELECTION. The avoidable Constitutional Crises that Ghana has been plunged into by the Jean Mena-led EC, is the product of incompetence on the part of Mrs. Jean Adukwei Mensa and the bad corporate governance practices she adopted. Disenfranchising the people of Santrokofi, Akpafu, Likpe and Lolobi could have been avoided by the early creation of the New Guan Constituency following the creation of the Oti Region out of the Volta REgion over two (2) years ago and the creation of a New Guan District. The Jean Mensa-led EC gave assurances to the people of Santrokofi, Akpafu, Likpe and Lolobi that they would vote in the 2020 Presidential and Parliamentary election, however, less than 24hrs to the voting, on a Sunday when no court ACTION was possible; the Electoral Commission issued a written statement indicating that the people of Santrokofi, Akpafu, Likpe and Lolobi could only vote in the Presidential Election but not the Parliamentary election.  The EC’s action of disenfranchising the people of Santrokofi, Akpafu, Likpe and Lolobi is unconstitutional; as it denies them representation in Parliament for four (4) years.  The Constitution requires that Ghana is divided into Constituencies for the purpose of election and such elections must result in all parts of Ghana being represented in Parliament. This act of omission on the part of the Jean Mensa-led EC is the subject of two (2) separate law suits affecting two (2) Parliamentary Candidates and Members of Parliament in two (2) Constituencies across two (2) regions which this Petition leaves to the courts to so determine. The dilemma of the people of Santrokofi, Akpafu, Likpe and Lolobi, who are bona fide Ghanaian Citizens, is fundamental to the Representation of the people, undermining the very essence of Parliament as the House of the Peoples Representatives and an attempt at extinguishing the fundamental rights of a section of registered Ghanaian voters. 3.. ELECTION SECURITY: There  were very grave security breaches recorded at all elections related activities organized by Mrs. Jean Adukwei Mensa such as the New Voters Registration exercise, Voters Exhibition exercise, Bye-election, the 2020 Election especially at Collation Centres where deaths were recorded. An illegal National Security SWAT Team of uniformed armed masked men led by ASP Azugu, which included known NPP Militiamen e.g. "DOUBLE" who were recruited from the Delta Force and Invisible Forces invaded and violently disrupted the Ayawaso West Wuogon Bye-Election. It emerged during the public hearings of the Justice Emil Short Commission of Enquiry on the Ayawaso West Wuogon Bye-Election Violence, that these NPP militiamen were deployed on blind side of the National Security Minister, Mr. Kann Dapaa and the entire Police Command by the Minister of State in-Charge-of National Security at the Office of the President, Hon. Bryan Acheampong. Mrs. Jean Adukwei Mensa under oath, committed PERJURY before the Commission of Enquiry, when she claimed to be untrue the presence and actions of the uniformed armed masked men who invaded the Ayawaso West Wuogon bye-election, despite video evidence to the contrary. The uniformed armed masked men by their violent conduct and shooting at the residence of the NDC Candidate and near the polling station early on voting day, deliberately scared prospective voters resulting in an EXTREMELY LOW VOTER TURNOUT in the stronghold of the NDC candidate leading to the election of the NPP candidate. The entire Police Command, from then Inspector General of Police (IGP) Mr. Asante Apeatu to the Regional Director of Operations Mr. Kwesi Ofori, all denied knowledge nor involvement in the Ayawaso West Wuogon SWAT operation which involved uniformed armed masked men who used police branded vehicles to carry out the criminal act. President Akufo Addo’s disregard of the recommendations of the Justice Emil Short Commission of Enquiry; emboldened others to emulate the Ayawaso West Wuogon mayhem.  The President's decision not to punish his Special Initiatives Minister Hon. Hawa Koomson for shooting at a Registration Centre set the tone for a series of violent events ending with the fatal shooting by a National Security operative "COLA" from the Office of the President.  The Collation Centres became militarized zones after the elections of 7th December, 2020. Despite various public assurances from the Inspector General of Police (IGP) on behalf of the EC ELECTION SECURITY COMMITTEE that the Military, National Security Council (NSC) and BNI will play absolutely no part in the ELECTION 2020 SECURITY ARCHITECTURE; the Election Collation Centres on election day were flooded with armed men in Military and Police uniforms who in some instances opened fire on civilians resulting in fatalities. President Akufo Addo has not set up a Commission of Enquiry into these ELECTION 2020 SHOOTING incidents. Inaction on the part of the President Akufo Addo has fed into public suspicions that the NPP was actively involved in these militia operations as indicated by some of the armed masked militiamen in videos claimed that Ayawaso West Wuogon was a dressed rehearsal for ELECTION 2020. The invasion of Parliament by armed police officers and a detachment of military personnel from the Office of the President on 7th January, 2021 during the Speakership Election, which election, though not organized by the EC; an act which has been described as a COUP by some MPs is being normalized by others citing the events of previous elections and related activities of the EC. 4. ELECTION MALPRACTICES: Record high voting figures, videos depicting multiple voting which went viral on social media and other electoral irregularities characterized the referendum on the creation of New Regions.  Ballot Tampering, opening of Ballot Boxes without authorization and Ballot Paper Snatching have become the new normal under Mrs. Jean Adukwei Mensa's tenure as chairperson of the EC.  Ballot papers embossed with the EC official stamp Pre-thumb printed in favour of the NPP Candidate were found on some persons before the elections, while similarly pre-thumb printed ballot papers bearing the EC official stamp were found dumped after the elections.  It is important to note that very significant quantities of the ELECTION 2020 ballot papers were printed by the Ghana Publishing Company headed by a former NPP Parliamentary Aspirant and a self-confessed Akufo Addo protegè, Mr. David Asante. 5. Botched Referendum on the ELECTION of DCEs: The neutrality of the EC was seriously compromised as members of the EC notable among them, Dr. Bossman Asare joined President Akufo Addo to campaign for a YES VOTE while the NDC led by Former President John Mahama campaigned for a NO VOTE. The President ordered the independent Electoral Commission to abort the Referendum VOTE when it became apparent that the NDC in Parliament would not do the bidding of the President, the supposedly independent Electoral Commission heeded the President's order and aborted the Referendum which the NO VOTE was poised to win. Interestingly, 20% of the ballot papers for the aborted referendum were printed two (2) weeks ahead of schedule by the Ghana Publishing Company headed by the former NPP Parliamentary Aspirant and Akufo Addo protegè, David Asante. 6. Procurement Breaches: It was alleged by IMANI that the company that won the bid to supply the BVDs was illegally termination and the bidding process recreated in favor of Thales that led to the resignation of the Chairman of the Entity Tender Committee of the Electoral Commission. Members of the Electoral Commission's Entity Tender Committee and IMANI who have publicly accused the EC and Jean Mensa of Procurement Breaches, can provide specific details of items under reference and further assist the Chief Justice Committee to establish a Premafacie case against offending EC officials including the Chairperson, Mrs. Jean Adukwei Mensa.  7. PERJURY at Ayawaso West Wuogon Commission of Enquiry: Mrs. Jean Adukwei Mensa under oath before the Commission of Enquiry, committed PERJURY despite video evidence to the contrary, she denied the presence and actions of the uniformed armed masked men who invaded the Ayawaso West Wuogon bye-election and ultimately scared prospective voters resulting in an EXTREMELY LOW VOTER TURNOUT. Beyond PERJURY constituting a criminal offence, the misconduct of Mrs. Jean Adukwei Mensa, goes to her character, integrity and suitability as a public officer let alone a Commissioner of an independent Constitutional body such as the Electoral Commission which requires the highest form of CREDIBILITY and INTEGRITY of its personnel to discharge its duties. Mrs. Jean Mensa is accused by several Members of Parliament of making False Declarations before the Parliamentary Special Budget Committee. 8. False declaration of RESULTS: The history of false declarations and lack of candor on the part of Mrs. Jean Adukwei Mensa before the 2020 election made it difficult to accept the results of that election especially when she started changing the figures of the Presidential Election Results. The self-imposed 24hr deadline to finish collection, collation and declaration of a sensitive PRESIDENTIAL ELECTION RESULT was a recipe for disaster. Despite several warnings that it was unrealistic, Mrs. Jean Adukwei Mensa willfully continued on that path till she eventually had to postpone the earlier deadline by another 24hrs then went into a series of WRONG DECLARATIONS with calculation errors and a string of faulty corrections.  This comedy of errors and corrections was even more ridiculous when the GAZETTE publication became shrouded in similar errors and manufacturing of undeclared RESULTS.  The Parliamentary GAZETTE was published by the Ghana Publishing Company headed by the former NPP Parliamentary Aspirant and Akufo Addo protegè, David Asante under controversial circumstances requiring investigation into the leakage of error-riddled Gazette Results on social media.  Mr. David Asante contradicted Mrs. Jean Adukwei Mensa on national Television and Radio relative to the official release of GAZETTED PARLIAMENTARY ELECTION RESULTS which included the uncollated TECHIMAN SOUTH and injuncted HOHOE RESULTS. 9. Use of defective National Identification Authority (NIA) GhanaCard: The EC officially indicated it would not use the National Identification Authority database nor the GhanaCard for the compilation of a New Voters Register. stating the defects and how it will compromise the New Voters Register data which the EC had promised to be 100% perfect devoid of any foreigners nor minors being present on the New Voters Register and for which reason the use of Birth Certificates as proof of Ghanaian Citizenship was outlawed. However, the EC proceeded to use the GhanaCard and by extension the inadequate and flawed data from the NIA to create its New Voters Register therefore only succeeded in removing the names of dead persons but not that of foreigners and minors as promised.  The old register and biometric equipment which the EC said was about 99.7% accurate, thus was replaced with a less accurate one at a VERY HIGH Financial, Personal and Health cost. 10. COVID-19 RISK: The Jean Mensa-led Electoral Commission undertook the avoidable New Voters Registration and Exhibition exercises during the COVID-19 pandemic at great risk to millions of Ghanaians.  The 2020 ELECTION itself was also conducted during the global second wave of the COVID-19 pandemic at even greater risk to millions of Ghanaians.  Many Ghanaians have been infected by the Coronavirus within 2020 with several high profile personalities undergoing quarantine including the then President, Speaker and Chief Justice. Other Ghanaians sadly lost their lives to COVID-19 included the Former General Secretary of the NPP, Former President Rawlings, Director of Policy at the Office of the President and the current National Security Coordinator. The Chairperson of the COVID-19 Fund and the former Chief Justice Sophia Akuffo and the Ghana Medical Association have blamed the latest spike in COVID-19 cases to election 2020 related activities; a position that was advanced for the avoidance of the compilation of a New Voters Register. The cumulative effect of the above ten (10) above have resulted in a number of Secondary actions: i. One (1) Presidential Election dispute. Changing of ELECTION RESULTS several times after the Electoral Commission’s self-confessed wrongful declaration of the Presidential Election RESULTS.  ii. Sixteen (16) Parliamentary Election disputes. Collation disputes and injunctions arising out of Electoral commission acts and omissions. iii. Observers damning reports on Collation of Election 2020. EU/AU observers affirm that the collation of ELECTION RESULTS was done in an opaque manner thus NOT TRANSPARENT. iv. Several Security Breaches and Violence. PETITIONS for an ENQUIRY into the ARMED INVASION of various Collation Centres and the SHOOTING incidents some of which resulted in DEATHS and injuries. a) These took root from Ayawaso West Wuogon shooting spree.  b) These spilled over into armed invasion in Parliament.  c) These emboldened the deployment of armed personnel to intimidate some Ghanaians and go on the SHOOTING sprees during the Registration exercise.  v. DISENFRANCHISEMENT. Disenfranchisement of the PEOPLE of Santrokofi, Akpafu, Lolobi and Likpe by not creating a new Constituency for them ahead of the 2020 ELECTION.  a) Court cases and  b) Public Agitation (including Demonstrations) vi. ENDANGERMENT Endangerment of Ghanaians in the COVID-19 pandemic era during the Registration exercise, Exhibition exercise and the ELECTION proper resulting in possible infections and spike in COVID-19 positive cases. On the basis of the above instances and additional information to be sourced from aforenamed organizations of stated misbehavior, gross incompetence, bias and procurement breaches, the undersigned demand the REMOVAL OF THE ELECTORAL COMMISSION CHAIRPERSON, Mrs. Jean Mensa from office invoking Article 146 of the 1992 Constitution of the Republic of Ghana. It is the expectation that, flowing from this instant Petition, the President consistent with his earlier record on a previous Article 146 Petition for the Removal of an EC Chairperson, accordingly act with same dispatch as the CONVEYOR BELT for this instant Petition.  SIGNED this 18th Day of January 2021 AND DULY SUBMITTED at the Office of the President. He Is A Congenital Liar* Mr Kweku Agyemang Manu was asked a specific question by Haruna Iddrisu which specific COVID-19 VACCINE is Ghana buying? The minister designate answered Astrazeneka The fact is that the Astrazeneka VACCINE is ineffective against the variants of Coronavirus currently prevalent in Ghana responsible for the the current steep spike in COVID-19 POSITIVE CASES and DEATHS in Ghana. Before, Ghanaians were promised 94 new hospitals last year but from the revelations no work has been done in that regard despite the fact that the government has borrowed so much to the tune of gh 297,000 billion. According to the minister designate estimated cost per district hospital is $7 million. This in Ghana Cedis is about 45.5 billion. Interestingly Ghanaians are told the nation does not have enough resources to run the critical sectors of the economy. No actual works have started on the 94 hospitals promised by Nana Akufo Addo last year. They can not meet the timelines. The health sector is bedeviled with lots of infrastructure facilities. We still have no beds syndrome and no equipment in our health facilities across the country. The 98 district hospitals including the regional hospitals construction have been fiasco. Now the promise is to construct 109 hospitals. Gallant Cadres of NDC view is that it does not make sense La General Hospital was demolished at height of COVID-19 pandemic with a promise to build a State-of-the-art Hospital Complex. But current the project has been abandoned and is being used to play socksball. The government of Nana Akufo Addo is simply unable to contain Covid-19. It has no clues, plans and strategies to fight Covid-19. Several positive COVID-19 patients are turned away from the hospitals. The effects of the drones in this fight are zero. Again, the claim that over 90,000 health workers have been recruited is false. The true figure is around 3, 000. As Ghana faces imminent shortage of health workers, we are told that the government is exporting health personnel outside. It is untenable government decision to use drones for COVID-19 vaccination exercise. It is impossible. Mr Agyemang Manu tells Ghanaians government is now going to build Oxygen plants in Ghana. We can be serious in this country. Photos taken a few minutes ago, from the site that used to house the La General Hospital show that the Minister for Health- Designate Kwaku Agyemang Manu, a few minutes ago lied to the Appointments Committee that work has commenced on the construction of a new hospital infrastructure after the Akufo-Addo government closed down,and and pulled down the La General Hospital. This will be the second matter before the Committee that the nominee has lied about. The La General Hospital was upgraded from a Polyclinic by the NDC, with plans to adequately expand and enhance not only the infrastructure but also modernise the equipment. It is sad that the Minister- nominee would lie under oath. According to the Mr Kweku Agyeman Manu the World Bank support has been used to procure PPEs but Ghanaians do not have nose masks, hospitals and health workers complain about lack of PPEs. Over $100m have been exhausted and now $120m is about to be eaten. Will there be a *RUN-OFF* or will one of the contesting Parties in Court *[JOHN MAHAMA or AKUFO ADDO]* be declared by the Supreme Court as *THE PRESIDENT?* _What are the issues?_ *VERY SIMPLE*: DID ANY CANDIDATE GET *50%+1* of the TOTAL VALID VOTES? *IF SO, WHO IS IT?* IF NOT, RUN-OFF! WHY THE CONTROVERSY? _*the information below is plagiarized;* but VERY TRUE_ *Jean Adukwei Mensah and the EC hav put out different Total VALID VOTES Figures of the 2020 Presidential Elections:* 1. *9th December, 2020* declaration of Presidential Election Results by the Returning Officer, Jean Adukwei Mensah- *13,434,574* 2. *10th December, 2020* unsigned press release published on EC’s website- *13,119,460* 3. *Paragraph 24* of the 1st respondent’s (EC) answer to the Petition- *13,121,111* NB: note that all these different figures relate to results from *274 constituencies* at the time of the declaration of the Presidential Election results on *9th December, 2020* (excluding Techiman south) 4. Collated total valid votes from the summary results sheets of *275 constituencies* (including Techiman South) published on the EC’s website- *13,218,633* NB: Note that per the Techiman South summary results sheets, total valid votes was *97,227*. It’s therefore baffling how total valid votes relative to *275 constituencies* as captured on EC’s website should be *13,218,633*. Because if you add *97,227* to any of the three (3) different total valid votes figures based on *274 constituency* results *(13,434,574 or 13,119,460 or 13,121,111)* you will not get *13,218,633*. The importance of the *TOTAL VALID VOTES* figure in any Presidential Elections cannot be the over-emphasized. The *TOTAL VALID VOTES* is the constitutional and common denominator for determining the *percentages of votes* obtained by each of the candidates. The *TOTAL VALID VOTES* ACCURACY is therefore CRUCIAL to *CREDIBILITY OF THE RESULTS.* *The INCONSISTENT TOTAL VALID VOTES* figures the EC’s itself has put out since *9th December, 2020* therefore calls into question *the CREDIBILITY OF THE entire RESULTS DECLARED, ENACTED and GAZETTED by the EC.* Hope you now understand why the General Secretary of the NDC, *Johnson Asiedu Nketia says in his witness statement* that the EC deliberately cooked figures to achieve a predetermined outcome? *Monday, the Supreme Court will continue to hear the ELECTION PETITION, STAY FOCUSED!* God SAVE our homeland Ghana! *AMEN!*

See how the Supreme Court kept shifting the goal post in today’s hearing: The court gave two reasons dismissing the application for interrogatories: 1. That CI 99 makes Order 22 of CI 47 (on interrogatories) inapplicable; and 2. That the questions in the interrogatories were ALL irrelevant. Tsatsu tackles the first ground and argues that there’s nothing in CI 99 which repeals Order 22 of CI 47 (on interrogatories) or makes inapplicable. The Court saw the sense in that argument and shifted to rely on the second ground, namely, that they dismissed the application on the ground that the questions were all irrelevant. Ok. Tsatsu crossed them there too and reiterated the questions in the interrogatories to show how relevant they are to the case. The judges got convinced there too and now quickly sought to say that Tsatsu could ask the questions during cross-examination. Ok. Then Tsatsu crossed them again with what seems to be the highlight of the day - “my Lords, if the questions are not relevant in the interrogatories, how can they be relevant during cross-examination? Then, the Court now says that he is crossing the bridge (of cross-examination) when the time has not yet come. To which the Tsatsu - Law Faculty - replied so elegantly - “I didn’t put the bridge there, you did.” Judge for yourself. (Copied)

We start work at 8am and come home when the Chinese people are ready to close sometimes 6 pm.No leave no pass WE WERE NOT ALLOWED TO SEE OUR LOVE ONES DURING THE CHRISTMAS BECAUSE THE CHINESE PEOPLE SAID THEY WANTED TO BREAK FOR XMAS and GOC said we can work ,WE WORKED ON 24TH,25TH AND 26TH DECEMBER.WE WERE RELIEVED ON 28TH BY THE FOLLOWING SOLDIERS AND LT OWUSU ANSAH WAS MAINTAINED THERE. W01 ALHASSAN WO1 ABBEY WO1 BABA WOII NKANSAH S/SGT ATORSAH SGT QUARSHIE SGT SARFO SGT BOAH EMMANUEL CPL NUREDEEN TACKIE CPL SAM CPL ABDUDALLA and 21 Other soldiers. For Immediate Release 22/01/2020 It is with deep sorrow that the state Ghana, who has come this far in her democratic experiment, has to lose a soul in its attempt to elect its President and Members of Parliament. For us, we neither see this development as ordinary nor one whose far-reaching implications can be under-emphasized because we believe that every single life matters in any nation building.    It would be recalled that the 2020 elections were marred with a lot of incidents of shooting that sadly caused us eight (8) lives. Whilst we ‘Ghanaian Women in Politics, (GhWIP) extend our hearty condolences to the families of the victims, we in that same spirit condemn the unfortunate events in all of its forms. Importantly, we would wish to use this occasion to appeal to the President of the Republic of Ghana, H. E Nana Addo Dankwa Akuffo-Addo to call for a national mourning and solemn recognition for these gallant heroes who lost their lives in their attempts to ensure the integrity of our democracy is preserved and protected.    As mothers and women with not just sympathy but also objectivity, we can imagine and feel the pain of the bereaved families and, for that reason, cannot just sit unconcerned. Given the background and circumstances, we find it a great duty to call for a peaceful, solemn vigil in honor of the departed souls. We also equally consider this exercise if heeded to an opportunity for the entire country to appease, heal and sympathize with the bereaved families and as well, pay our very last respect to the dead. Also, we wish to extend a plea to the Speaker of Parliament, Rt. Hon Alban Sumana Kingsford Bagbin, to take up this matter up as one of a national interest as we believe it would accord the incident the respect and seriousness it deserves.   As we may all know, death indeed is inevitable, however, the manner in which one leaves is one that must be of grave concern to all. In our pleadings, we further ask the Judiciary to kindly consider our requests as extended to the Presidency, Government, Parliament of Ghana, and the entire Ghanaian people to also show solidarity and great concern. We are of the firm belief that a minute of silence from the various arms of Government will cause us to unite as one people, and one nation aspiring for the common good of the mass of our people.   In furtherance of our democratic practice, The GhWIP will wish that in the future, institutions of state are enjoined to ensure a violent free election. We again call on the arms of government to work in unison to establish a committee to investigate the cause of the shootings during the polls to the later to serve justice to the bereaved families as such occurrences have rendered some childless whilst others widowed. This, we believe, will be a panacea for eliminating such behaviors in our political landscape.   We additionally plead for stiffer and tighter measures in our security institutions to prevent such happenings in our political space; for our road to democracy must not be about the survival of the fittest, rather an open gate for free expression of one’s franchise. The GhWIP believes in a peaceful and a prosperous Ghana that every citizen will live without fear and intimidation. As noble women of principles, we believe in the respect for the rule of law and the principles of liberty.   The nation Ghana must not dent her image in allowing her citizens to decide who must lead them, especially when it is widely known and recognized as a pacesetter for many African countries regarding the preservation of the rights of our people. The GhWIP would want to take this opportunity to mourn with the bereaved families and assure them of getting justice for their loss.   May the departed souls rest in power.  God bless our homeland Ghana and make our nation strong.  Long live GhWIP Long live Ghana   Aluta Continua!   Samira Regina Mbilla Akunkel President- 0244573201   Nadia Alhassan iv Vice President-0242222722 Bintu Saana Secretary: 0243378178

Don't put additional responsibility on the grassroots The 2020 election is a rebuke of Mr Akufo Addo. Ghanaian voters simply sent a message to him that enough is enough. His arrogant posturing towards governance would be a thing of the past. You cannot run nepotism a deliberate policy and when citizens complain, even appoint more. You cannot attack the Mills Mahama administration of excessive borrowing and when you got power, our debt to GDP ratio is now about 80% with 16% fiscal deficit. Completely destroyed the economy. Where is the moral authority to continue to rule? First time since 1992 that the declared winner, lost Greater Accra. Akufo Addo did not win one constituency in 4 regions of Ghana. Even Oti region he decided to create to just to break the Volta region, he lost all 8 constituencies. The Ghanaian voter has discernment. The NDC members on the Appointment Committee of Parliament have a huge responsibility. Ghanaians are looking up to them to sieve and weed out wicked, arrogant and dangerous nominees. I will not cast aspersions against any member of the NDC Appointment Committee. At least, I know most of them at close range. I don't have any evidence of anyone of them compromising himself or herself. But we have huge expectations of what they will be doing. Persons associated with Akufo Addo went to the expect of getting an injunction order against our MP for Assin North. Such individuals should not go through the Appointment Committee of Parliament. They are very dangerous for our democracy. Our members of the Appointment Committee of Parliament should look for the video of the vetting of Hon Fiifi Kwetey in 2009. Even with lesser numbers on the appointment committee then, look at how the NPP MPs behaved. There is nothing like national interest with NPP politics. It is all about keeping the NPP base happy. Godfred Yeboah Dame should come and justify why he was instigating the Special Prosecutor then to go after John Dramani Mahama and whether did not amount to interfering in his work? Ken Ofori Atta should tell Ghanaians what he was doing in the house of Martin Amidu when he was the subject of investigation by Martin Amidu. Dentist Matthew Opoku Prempeh should provide the evidence of John Dramani Mahama bussing parents and students to the Independence Square. Ursula Owusu decided to use NCA to destroy media businesses of persons perceived to be NDC, thereby creating huge unemployment. She specifically went after Radio Gold for a reason. Cut off the dominant voice of the NDC. Why should NDC members of the Appointment Committee of Parliament deal with her to advance the national interest? Was the closure of Radio Gold for the national interest? Our brothers and sisters in the NPP don't remember friendship. They remember only the NPP interest. The people who can put your National Chairman and deputy Com Officer for what offence? Can you imagine that in the trial of the National Chairman, the evidence of an offence taking place is the alleged audio recording without more. That's how the NPP operates. Demonization demonization demonization They weaponize prosecution for partisan ends. It is about justice but partisan politics. With the greatest respect to the NDC members of the Appointment Committee of Parliament, the time is now or never. The interest of the NDC is also national interest. Always remember the 8 members of the NDC killed by operatives of this despotic regime during the 2020 election. Their blood looking for justice and only justice. We are praying for you our members of the Appointment Committee of Parliament. Nothing can harm you our gallant soldiers who prevented the subversive activities of Mr Akufo Addo in the election of the speaker. God bless you greatly Ehedzo bodooo

The Executive Secretary of Anchoring Democracy Advocacy Movement Ghana (ADAM-GH) Mr Azubila's observation so far on the 2020 elections petition. Are the judges really interested in the merit of the case or only Concern on timelines C I 99?. There is public perception that, most of the judges hearing this elections petition case were appointed by President Nana Addo's Government as the electoral commissioner Mrs Jean Mensah who exhibited unprofessionalism since her asuption of Office leading to the case pending in court, which we wouldn't want to go into details. We are leaving in a regime where most INDEPENDENT Institutions like Ghana Police Service and Ghana Armed Forces misconduct themselves by killing innocent unarmed Ghanaians in favour of the ruling Government. The actions and comments of Some of the judges in this 2020 petition case is making most Ghanaians confused as whether this case can restore Ghanaians confidence in our INDEPENDENT Institutions. You are adjourning court from today 20th to 26th January 2021and yet talks about expedition, I don't understand. The former EC Chair Dr Kojo Afari Gyan in 2012 was scrutinized left right Centre and Ghanaians expect Mrs Jean Mensah to go through same scrutiny but the ruling Yesterday in the SC seem to be protecting Mrs Jean Mensah from answering quetions concerning her own actions which Ghanaians are not comfortable with. * As a civil society organization that anchors proper Democratic prinsciples and ensures good Governance, we fully agree with the lead council for the petitioner Lawyer Tsatsu Tsikata that "Justice can not be sacrificed for expedition". The whole world is watching the court procceedings and i think the actions of our judges speaks volume about the INDEPENDENCE of our Institutions and a justification of why we are in court today. The supreme court is our last hope so far as the Institutional independence and the future of Ghana's Democracy is Concern. The petitioners should immediately come out with their next line of actions after this court case whether good or bad, to seek Justice to prevent any negative future precedence in our Democracy. We don't want Government now or Government in future uses and manipulate our State Institutions with impunity just because they have Political power. Political parties must not be given the oppotunity negatively to retrogress our growing Democracy.

It seems to me that your attack is with the personality and not the office…We will be happy if you just limit it to the office and not the EC because in her absence any of her deputies could step in. Tsatsu: Respectfully my lord, there is only one Returning Officer for the presidential election and that is the EC chairperson. Justice Nene Amegatcher: let’s leave it at that, chairperson of the Electoral Commission and not her person Tsatsu: But my Lord, she is the Chairperson and she has a name, or I am not allowed to mention the name of the Chairperson Justice Nene Amegatcher: The question should be to the office Tsastu: I want to understand I am being prohibited from mentioning the name of the Chairperson, is that the issue? Justice Nene Amegatcher: Reading through your petition which makes constant emphasis on the name, what I am telling you is that we will be satisfied with the designation because in her absence any of her deputies could act in that position Tsatsu: My Lord… Justice Nene Amegatcher: So, it is an election petition and you are challenging the election, it is sufficient that the institution charged with the conducting that election had done their work and the Chairperson who is the head represent that institution and not the personality Tsatsu: With the greatest respect, I believe that the constitutional requirement regarding the returning officer and the particular circumstances do not make it possible step in for the Chairperson, it cannot be like you are envisaging. Justice Nene Amegatcher: The institution had done the work and not the personality Tsatsu: The particular circumstances that we are dealing with in this case, do not make it possible to have the situation that you are envisaging where you have somebody else step in for the Chairperson. The constitution makes the Chairperson and only that person the Returning Officer and in the circumstances of this case that Chairperson happens to be the person we referred to in the petition who undertook her responsibility in accordance with the constitution and legal situation that we have, I am not mentioning her name by targeting her individual…that is far from it. I do not target her when I mention her name as the person who declared the results, that is a fact. Justice Nene Amegatcher: Thank you, you may continue with your interrogatories” 🤦🏿‍♂️

The essence of interrogatories is to fast track trial especially when it comes to cross-examination. In other words the essence of it is to limit the number of days to be used for cross examination. If the application is denied, the applicant does not suffer any loss as he/she will have opportunity to put the same questions to the respondent when he/she enters the witness box. What this simply means is that, the denial of the petitioner's application does not in anyway stop his lawyers from putting these questions to the first respondent (EC) when Jean Mensah mounts the witness box. It does appear that the court is minded by the 42 days expiration period and would not entertain confounding issues. In this kind of litigation, strategy matters. Sometimes you need to test the thinking of the Court and that is exactly what the petitioner sought to do. Copied From: Amorse Blessing Amos
